## Myth 2: Customers must provide their data when using digital receipts

Completely anonymous transmission by scanning QR codes is possible every time and at a low cost. The fact that the collection and storage in connection with personal data (e.g. customer apps, etc.) brings further advantages for retailers, but also for consumers, is of course different matter.

## Myth 3: Digital receipts increase waiting times at the checkout

In some industries, payment processing at the checkout would be significantly slowed down. This may be the case if personal data first has to be captured in a time-consuming manner, but not if the delivery of a digital receipt works via QR code or, even better, with direct banking integration.

## Myth 4: Digital receipts are not automatically sent to the tax office

[A legally compliant receipt issuing obligation within the framework of the Austrian Registrierkassensicherheitsverordnung (RKSV)](https://www.bmf.gv.at/en/topics/taxation/cash-register/cash-register-receipt-issuing-obligation.html) is also ensured by digital receipts. It is also true that every cash register is directly connected to the Ministry of Finance via an interface, but this is only used to register the cash register and its security devices, as well as their configuration. A transmission per transaction or a receipt does not take place this way.

In Álava and Gipuzkoa, 99% of businesses already comply, while in Bizkaia, implementation is being phased in under the Batuz system until 2026.

### Fiscalization for big companies: Immediate Supply of Information (Suministro Inmediato de Información or SII)

The Immediate Supply of Information (SII), in effect since 2017, will remain mandatory in 2025 for large enterprises, those included in VAT groups, and entities registered in the REDEME system (monthly VAT declarations). This system allows for near real-time tracking of VAT records via the Spanish Tax Agency (AEAT) platform.

The SII is mandatory for:

* Companies, businesses, and taxpayers based in Spain with annual revenues exceeding €6 million;
* Entities included in VAT groups;
* Entities registered in the REDEME system for monthly VAT declarations.

Other businesses and professionals can also voluntarily opt into the SII.

#### SII technical requirements 

The SII focuses primarily on the obligation to electronically declare information about issued and received invoices, among other data, by submitting electronic VAT records to the AEAT in Spain.

The required VAT records include:

* Record of issued invoices
* Record of received invoices
* Record of investment goods
* Record of certain intra-community transactions

Generally, information must be submitted to the relevant tax authority within a maximum of four working days from the issuance or receipt of invoices. While the AEAT provides XML file structures and a specific communication process, the SII, unlike TicketBAI or Verifactu, does not require:

* Chaining of records,
* Electronic signatures, or
* Certification of the management software used for information submission.

#### Coexistence of SII with Verifactu and TicketBAI

As mentioned earlier, the Spanish tax system is complex, with various regional and national tax authorities, as well as multiple regulations affecting different types of businesses. Thus, Verifactu and TicketBAI will coexist with the SII system.

### Crea y Crece Law and e-Invoicing

Law 18/2022, enacted on September 28 and known as the [Crea y Crece Law](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2022-15818), was designed to promote digitalization, reduce late payments between businesses and professionals, and improve management processes through mandatory e-invoicing, among other measures.

#### What does the Crea y Crece Law entail?

According to Article 12, companies and freelancers will be required to issue and receive e-Invoices through providers that ensure interconnection between platforms and the e-Invoicing formats specified by the law.

The obligation to issue e-Invoices applies to B2B transactions where both the client and recipient operate in Spain. Businesses must issue e-invoices using software that complies with the law, is registered with the AEAT, and ensures proper connection to the public e-Invoicing solution, where records will be submitted by taxpayers. This requirement will only apply to complete invoices, not simplified ones.

e-Invoicing systems must:

* Ensure interconnection between e-Invoicing platforms.
* Comply with AEAT-specified formats for issuing complete invoices.
* Connect with the AEAT’s public e-Invoicing solution to submit records.

In order to support companies and professionals in the province, Biscay's tax authorities have decided to extend the implementation period of Batuz from 2024 to 2026. As you may know, [TicketBAI is a part of the extensive Batuz](/blog/ticketbai-and-batuz-in-bizkaia) economic activity control strategy in Biscay.

The initial calendar stipulated that, in January 2024, all companies and professionals in the territory of Biscay would have to comply with the new TicketBAI regulations against tax fraud. However, as of August 2023, only 17% of companies have adapted their processes to comply with it, despite the tax incentives provided by the early implementation of this system.

That's why Biscay's tax authorities [have recognised the difficulty of maintaining the previous schedule](https://www.bizkaia.eus/es/web/comunicacion/noticias/-/news/detailView/25477), and they have extended the implementation dates from 2024 to 2026. Below you will find the new mandatory dates, established gradually for different types of companies and with adaptation periods of six months at a time.

## New TicketBAI implementation timeline in Biscay

* **1st January 2024:** corporate taxpayers who are not Micro-SMEs. In other words, companies with a turnover of more than €2 million of which only 13% of them have voluntarily adhered to Batuz to date.
* **1st July 2024:** micro-SMEs operating in the following activities: industrial, manufacturing, construction and transport, financial, legal, insurance, rental and other professional activities except for education and cultural activities. This group represents 50% of the business and professional sector of Biscay and, for the moment, only 21% of them have implemented Batuz and TicketBAI voluntarily. 
* **1st January 2025:** micro-SMEs operating hospitality and catering, trade, commerce, repair of movable goods, hairdressing and other personal services (legal entities and ERARs with PJ). This group represents almost 9% of the economic activity and 15% of them already comply with Batuz and TicketBAI.
* **1st July 2025:** micro-SMEs dedicated to hospitality and catering, trade, repair of movable goods, hairdressing and other personal services (in this case, natural persons and ERARs without PJ). They occupy 20% of the global Biscay’s activity and only 10% of them have voluntarily opted in so far. 
* **1st January 2026:** entities totally and partially exempt from corporation tax (Impuesto de sociedades); non-profit entities; and companies dedicated to agriculture, livestock and fishing, education, cultural services and the rest of taxpayers.

## Requirements in Bizkaia

The TicketBAI software in the billing or POS system must generate XML files for each transaction and sign them with a digital certificate. It also provides a QR code and ID code to print on the invoice. The invoices are chained by the software into a sequence so their trace can be verified in a sequence and the XML files are stored for an established period of time.

The content of the XML files in Bizkaia slightly differs from the content in the other two provinces. For instance, sending the details of each line or the recipient's address is not mandatory.

### LROE

Besides implementing TicketBAI, taxpayers in Bizkaia will have to send the LROE books (Book of economic operation registries) to Bizkaia's Provincial Council. The TicketBAI XML files are included within the LROE books. The LROE books must be sent every trimester before April 25th, July 25th, October 25th, and January 31st, depending on when the transactions occurred.

## SII obligations in Bizkaia

In Bizkaia, TicketBAI and LROE replaces the SII. However, those companies already compliant with the SII system will have to keep sending their registries every four days (or according to SII deadlines).

BATUZ and TicketBAI are initially implemented on a voluntary basis in Bizkaia before becoming mandatory for all activities at the same time. Here you find the deadlines:

**Software Provider**: Designs and builds the system according to the Revenue Agency’s technical requirements. The provider must be pre-accredited, and their solution must pass certification and approval by the Commission for Fiscal Measuring Devices.

**Software Distributor:** The entity that delivers the solution to the merchant and provides technical and operational support. Often the provider and distributor are the same entity, but not necessarily.

This structure ensures clear distribution of responsibility across development, delivery, and usage, guaranteeing compliance and security.

## Approval Process for Software Solutions

To be legally used, each software solution must undergo an approval process defined by the Revenue Agency. First, the Software Provider must be accredited. Only accredited entities can begin the certification process.

The solution must comply with the technical specifications and security requirements laid out by the Agency. Once developed, it must be submitted to the Commission for approval of fiscal measuring devices, which will evaluate its accuracy, safety, and regulatory compliance. Only after official approval can the solution be distributed and used by merchants.

## Fiscal incentives for voluntary adoption of BATUZ in Bizkaia

The compensation for voluntarily adopting the BATUZ system (which encompasses [compliance with TicketBAI](/signes/ticketbai)) targets individuals, as well as micro, small, and medium-sized companies liable for corporate income tax. Eligibility hinges on adherence to BATUZ and meeting its criteria.

These taxpayers will qualify for a **10% compensation in either Personal Income Tax (IRPF) or Corporate Income Tax (Impuesto de Sociedades)** under the following circumstances:

**In 2024:**

* This applies universally to those who joined BATUZ voluntarily in 2022 or 2023.
* Alternatively, for those joining from 2024 onward, their implementation must precede their mandatory deadline by at least 6 months as specified in the regulations.

**In 2025:**

* If they are at least 6 months ahead of their mandatory implementation date as outlined in the regulations for complying with BATUZ, whether they joined during the voluntary period (2022 and 2023) or afterward from 2024 onwards.

Furthermore, to incentivize the adoption of BATUZ and TicketBAI, and in accordance with the regulations outlined in Foral Regulation 8/2023, which establishes measures for the definitive implementation of the BATUZ system, Bizkaia has introduced **a 30% deduction in the tax burden of Personal Income Tax (IRPF) or Corporate Income Tax (Impuesto de Sociedades) until 2025**. This deduction encompasses expenses or investments associated with the implementation of BATUZ, including:

* Procurement of essential electronic signature software, along with its implementation and installation.

## What applies in all provinces?

All invoicing systems have to be compliant with TicketBAI. This means the billing or POS systems must be equipped with software that:

1. is registered in the Provincial Software Registration List.
2. chains the invoices so that their trace can be verified in a sequence, preventing manipulation, alteration, or deletion.
3. creates XML files for each transaction, signs them with a valid digital certificate, and sends them to the corresponding Tax Authority.
4. stores all the XML files during the established period of time.
5. generates a QR code and an Identification code which must be printed on the invoice. 

## What are the differences between the provinces?

The differences in compliance with TicketBAI in each Basque province are as follows:

1. Each province has its own Tax Authority to send the files to, depending on where the taxpayer is registered.
2. The content of the XML file may differ slightly between the provinces.
3. In Bizkaia, TicketBAI is part of a more comprehensive strategy called Batuz. 
4. There are differences between the provinces regarding TicketBAI replacing the SII system or not.

The compliance law TicketBAI was also introduced in the Province of Araba. In this blog post you will learn the details about the implementation of TicketBAI in Araba. TicketBAI compliance is established in Araba by the Foral Decree 48/2021, of October 5th, and aims to prevent tax tampering.

## Requirements in Araba

## TicketBAI deadlines in Araba

In Gipuzkoa, TicketBAI is initially implemented on a voluntary basis and then on a mandatory basis. In several stages, the mandatory implementation will take place. We have listed the implementation deadlines here.

**01/04/2022:** Mandatory period starts for consultancies that collaborate with Araba’s Provincial Council

The law's enforcement date was originally set for January 1st, 2023, but postponed in order to give POS vendors more time to incorporate digital receipt functionalities into their software.

This year’s Earth Day on April 22 is all about the motto “Invest in our planet”. Did you know that single-use paper receipts have a bigger impact on our health and the environment than you might realize?

## Paper receipts contain BPA

The chemical Bisphenol-A (BPA) commonly found in the thermal paper that is used for the printing of paper receipts, has been linked to various health issues, including cancer. Since BPA is readily absorbed through the skin, especially cashiers and people who handle receipts frequently are exposed to higher levels of the harmful substance than the general population.

## Paper receipts are non-recyclable

As most receipts are printed on thermal paper, which has a chemical lining, they cannot be recycled as paper. Paper receipts for single use are usually printed automatically, which leads to them being thrown away as direct waste. Digitizing receipts is the most sustainable option for providing and archiving receipts.

## Paper receipts use a lot of resources

The production of paper receipts requires significant amounts of natural resources. Besides the environmental impact of thermal paper, using non-thermal alternatives generally means higher printing costs for businesses. In thermal paper, the heat-sensitive coating material reacts to the heat generated by the thermal printer to produce the text or image. Because no ink or toner is required, the cost is lower compared to non-thermal printing methods. By contrast, digital receipts do not require physical materials, reducing waste, and saving businesses time and money.

Take your POS to the next level

Imagine this: you walk into a bakery to buy a donut or a croissant. Your treat is adorned with a sugar glaze receipt showing the price, quantity, and receipt number. In January 2020, 200 sugar glaze receipts embellished the traditional Bavarian filled donut (the so-called Krapfen), in a Bavarian bakery. This wasn't an expression of affection for the aesthetics of receipts by the bakers; it was a protest against the introduction of the [mandatory receipt issuance law in Germany](https://kassensichv.net/en/articles/receipt-issuance-obligation-in-germany-background-effects-and-alternatives) in January 2020.

The receipt issuance obligation aims to [ensure the transaction is recorded in the cash register system](https://www.spiegel.de/wirtschaft/service/bon-pflicht-neues-kassengesetz-hat-folgen-fuer-die-umwelt-a-1297036.html) and prevent tax evasion. "Stop the receipt and trash madness immediately," demanded the Central Association of the German Bakers back then. In response to protests from bakers and many other industries, the federal government sought to appease concerns by emphasizing that [receipts could also be issued electronically](https://www.spiegel.de/wirtschaft/service/scholz-erlaubt-wildwuchs-bei-digitalen-quittungen-a-08e30e90-f1b0-44f4-815d-b37c6e00b2bc). Concrete guidelines were however not forthcoming; implementation was left to individual companies.

## The e-receipt is here to stay
Today, transitioning to electronic receipts is only a matter of time. Bitkom states that [digital receipts already play a role for 44% of companies.](https://www.bitkom.org/Bitkom/Publikationen/Elektronische-Beleg-und-Rechnungsdaten-im-Jahr-2022) According to a [2022 study on POS systems by EHI](https://www.ehi.org/produkt/studie-pos-systeme-2022-pdf-version/), approximately 34% of all receipts in Germany can now be issued digitally. The forecast for the future is 95%. [Companies like Rewe already offer digital receipts](https://mediacenter.rewe.de/pressemitteilungen/papier-sparen-mit-rewe-app-und-ebon) through their app.

Innovation often becomes possible only when businesses, as well as consumers, are ready for it. A popular example is the predecessor of the Macintosh: In December 1968, Xerox introduced a technology with a mouse and graphical display, the Xerox Alto. Accounts of that time suggest that managers at Xerox viewed typing correspondence as secretarial work and calculating numbers as tasks for the accounting department, hence showing little interest in the wider distribution of the Alto. The device was used only internally at Xerox. Many of the innovations in the Alto were later adopted by Steve Jobs for the Apple Macintosh, which was released in 1984 as the first commercially successful personal computer and revolutionized society. The Xerox Alto was ahead of its time.

## Saving paper and retaining customers
Society is more than ready for the e-receipt. The surplus paper generated by paper receipts is not only an [environmental burden](/blog/paper-receipt-facts) but also cumbersome: consumers rarely take receipts with them, and merchants must dispose of them at the end of the day. [If thermal paper is used](/blog/paper-receipt-facts), the receipts must be disposed of separately. This is a real problem, especially for businesses selling large quantities at low prices.

Furthermore, the electronic receipt is an opportunity to connect with consumers. Advertising or information initiatives can be [linked on the receipt through a barcode](/blog/digital-receipt-use-cases). In an economy where [community building](https://www.mckinsey.com/capabilities/growth-marketing-and-sales/our-insights/a-better-way-to-build-a-brand-the-community-flywheel) is central to maintaining and establishing a customer base, such communication is essential. People don't just want to shop; they are looking to be affirmed in their values, lifestyle, and sense of belonging.

## Empowering customers
In the future, it will become increasingly important to provide customers with a [pleasant shopping experience](https://www.accenture.com/us-en/insights/song/customer-experience-index). Digital receipts could be easily integrated into a [digital wallet](/blog/digital-receipt-by-fiskaly-integrated-into-google-wallet). They enable customers, especially in these times of perceived economic scarcity coupled with a desire for financial autonomy, to manage expenses digitally—[a growing trend](https://www.forbes.com/sites/melissahouston/2024/02/02/embracing-the-trend-of-loud-budgeting/?sh=169fc3d85d68).

Digital receipts are helpful for tax returns, as they allow individuals to collect their expenses in one place. Customers can also better exercise their right to return items—a right that studies show is often not utilized because [paper receipts are lost](https://www.ehi.org/produkt/studie-pos-systeme-2022-pdf-version/).

## Anticipating the Zeitgeist
The idea of people [keeping physical documents](https://www.theguardian.com/money/2019/sep/29/i-sold-our-house-and-gave-away-our-stuff-the-minimalists-doing-more-with-less) contradicts the concept of minimalism, which increasingly defines our time. Documents need to be stored, and storing is becoming more and more 'outdated.' Many people don't have home offices where they stack bulky folders of receipts over years. Young people, the consumers of the future, according to studies, [prefer to manage everything on their phones](https://www.pwc.de/de/handel-und-konsumguter/so-tickt-die-generation-z.html).

The digital receipt aligns with the zeitgeist on various levels much more than the paper receipt: it avoids paper waste, it facilitates communication with the customer, and it empowers customers to have better control over their finances and tax matters. Transitioning to this model is now a matter of time, much like the personal computer. Those who don't take this leap today will lag behind the competition. Merchants will want to offer the e-receipt and POS providers must be prepared.
