The Immediate Supply of Information (SII), in effect since 2017, will remain mandatory in 2025 for large enterprises, those included in VAT groups, and entities registered in the REDEME system (monthly VAT declarations). 

This system allows for near real-time tracking of VAT records via the Spanish Tax Agency (AEAT) platform.

The SII is mandatory for:

#### What does the Crea y Crece Law entail?

According to Article 12, companies and freelancers will be required to issue and receive e-Invoices through providers that ensure interconnection between platforms and the e-Invoicing formats specified by the law.

The obligation to issue e-Invoices applies to B2B transactions where both the client and recipient operate in Spain. Businesses must issue e-invoices using software that complies with the law, is registered with the AEAT, and ensures proper connection to the public e-Invoicing solution, where records will be submitted by taxpayers. However, as of August 2023, only 17% of companies have adapted their processes to comply with it, despite the tax incentives provided by the early implementation of this system.

That's why Biscay's tax authorities [have recognised the difficulty of maintaining the previous schedule](https://www.bizkaia.eus/es/web/comunicacion/noticias/-/news/detailView/25477), and they have extended the implementation dates from 2024 to 2026. Below you will find the new mandatory dates, established gradually for different types of companies and with adaptation periods of six months at a time.

## New TicketBAI implementation timeline in Biscay

* **1st January 2024:** corporate taxpayers who are not Micro-SMEs. In other words, companies with a turnover of more than €2 million of which only 13% of them have voluntarily adhered to Batuz to date.
* **1st July 2024:** micro-SMEs operating in the following activities: industrial, manufacturing, construction and transport, financial, legal, insurance, rental and other professional activities except for education and cultural activities. This group represents 50% of the business and professional sector of Biscay and, for the moment, only 21% of them have implemented Batuz and TicketBAI voluntarily. 
* **1st January 2025:** micro-SMEs operating hospitality and catering, trade, commerce, repair of movable goods, hairdressing and other personal services (legal entities and ERARs with PJ). This group represents almost 9% of the economic activity and 15% of them already comply with Batuz and TicketBAI.
* **1st July 2025:** micro-SMEs dedicated to hospitality and catering, trade, repair of movable goods, hairdressing and other personal services (in this case, natural persons and ERARs without PJ). They occupy 20% of the global Biscay’s activity and only 10% of them have voluntarily opted in so far. 
* **1st January 2026:** entities totally and partially exempt from corporation tax (Impuesto de sociedades); non-profit entities; and companies dedicated to agriculture, livestock and fishing, education, cultural services and the rest of taxpayers.

## Requirements in Bizkaia

The TicketBAI software in the billing or POS system must generate XML files for each transaction and sign them with a digital certificate. It also provides a QR code and ID code to print on the invoice. The invoices are chained by the software into a sequence so their trace can be verified in a sequence and the XML files are stored for an established period of time.

The content of the XML files in Bizkaia slightly differs from the content in the other two provinces. For instance, sending the details of each line or the recipient's address is not mandatory.

### LROE

Besides implementing TicketBAI, taxpayers in Bizkaia will have to send the LROE books (Book of economic operation registries) to Bizkaia's Provincial Council. The TicketBAI XML files are included within the LROE books. The LROE books must be sent every trimester before April 25th, July 25th, October 25th, and January 31st, depending on when the transactions occurred.

## SII obligations in Bizkaia

In Bizkaia, TicketBAI and LROE replaces the SII. However, those companies already compliant with the SII system will have to keep sending their registries every four days (or according to SII deadlines).

## BATUZ with TicketBAI deadlines in Bizkaia

BATUZ and TicketBAI are initially implemented on a voluntary basis in Bizkaia before becoming mandatory for all activities at the same time. Here you find the deadlines:

## Fiscal incentives for voluntary adoption of BATUZ in Bizkaia

The compensation for voluntarily adopting the BATUZ system (which encompasses [compliance with TicketBAI](/signes/ticketbai)) targets individuals, as well as micro, small, and medium-sized companies liable for corporate income tax. Eligibility hinges on adherence to BATUZ and meeting its criteria.

These taxpayers will qualify for a **10% compensation in either Personal Income Tax (IRPF) or Corporate Income Tax (Impuesto de Sociedades)** under the following circumstances:

**In 2024:**

* This applies universally to those who joined BATUZ voluntarily in 2022 or 2023.
* Alternatively, for those joining from 2024 onward, their implementation must precede their mandatory deadline by at least 6 months as specified in the regulations.

**In 2025:**

* If they are at least 6 months ahead of their mandatory implementation date as outlined in the regulations for complying with BATUZ, whether they joined during the voluntary period (2022 and 2023) or afterward from 2024 onwards.

## Deductions for TicketBAI and BATUZ software implementation

Furthermore, to incentivize the adoption of BATUZ and TicketBAI, and in accordance with the regulations outlined in Foral Regulation 8/2023, which establishes measures for the definitive implementation of the BATUZ system, Bizkaia has introduced **a 30% deduction in the tax burden of Personal Income Tax (IRPF) or Corporate Income Tax (Impuesto de Sociedades) until 2025**. This deduction encompasses expenses or investments associated with the implementation of BATUZ, including:

* Procurement of equipment and terminals, along with software and related peripherals, including their implementation and installation.
* Procurement of essential electronic signature software, along with its implementation and installation.

## What applies in all provinces?

All invoicing systems have to be compliant with TicketBAI. This means the billing or POS systems must be equipped with software that:

1. is registered in the Provincial Software Registration List.
2. chains the invoices so that their trace can be verified in a sequence, preventing manipulation, alteration, or deletion.
3. creates XML files for each transaction, signs them with a valid digital certificate, and sends them to the corresponding Tax Authority.
4. stores all the XML files during the established period of time.
5. generates a QR code and an Identification code which must be printed on the invoice. 

## What are the differences between the provinces?

The differences in compliance with TicketBAI in each Basque province are as follows:

1. Each province has its own Tax Authority to send the files to, depending on where the taxpayer is registered.
2. The content of the XML file may differ slightly between the provinces.

The compliance law TicketBAI was also introduced in the Province of Araba. In this blog post you will learn the details about the implementation of TicketBAI in Araba. TicketBAI compliance is established in Araba by the Foral Decree 48/2021, of October 5th, and aims to prevent tax tampering.

## Requirements in Araba

Software in the billing or point-of-sale system must generate XML files for each transaction, sign them with a digital certificate, and send them to Araba’s Provincial Council. The software must also provide a QR code and ID code to be printed on the invoice. Further, the software chains invoices into a sequence so their trace can be verified in a sequence and stores their XML files for an established period of time.

## SII obligations in Araba

TicketBAI affects those who are currently obliged to SII compliance. In Álava, TicketBAI does not exempt the taxpayer from SII obligations. TicketBAI is sending the information according to the “Issued Invoices” book. You do not need to submit the same information twice to the tax authority - only the additional books.

After all, with the increasing digitization of transactions and payment processes, why is the receipt still so often a paper slip?

## The current state of the digital receipt (2024)

According to figures from [EHI Retail Institute's 2022 study on POS systems](https://www.ehi.org/produkt/studie-pos-systeme-2022-pdf-version), nearly 34% of merchants offer a digital receipt option, with an even higher number in 2024. According to the prognosis, about 95% plan on offering their customers an electronic receipt in the future.

### Recent developments in the field of e-receipts

In order to understand the adoption behavior, let’s have a look at the history of electronic receipts.

* **Before 2015:** Basic digital receipts were delivered via e-mail.
* **2015:** New forms of transmittal are starting to be used, anonymous receipt delivery via easy [scanning of a QR code](/blog/static-and-dynamic-qr-code) is now an option for data-sensitive customers.
* **2021:** E-receipts are introduced to the mass market, and big retailers are starting to implement digital receipts in their apps, mostly tied to a loyalty program. The loyalty card is scanned at the checkout counter and the receipt is delivered automatically to the retailer’s mobile app. For customers, however, this requires constantly switching between multiple apps for each retailer they buy from.
* **2021-2023:** Digital receipts increasingly include new benefits and functionalities, such as lead generation, marketing to anonymous customers, and [online marketing in offline stores](/blog/digital-receipt-use-cases). 
* **2023:** Sustainability regulations such as the [French “Anti-waste law”](/blog/anti-waste-law-in-france) are raising consumer awareness – in France, printed receipts now only need to be issued when explicitly asked for by the customer and are replaced by digital receipts.

### The electronic receipt today (2024)

Despite the advantages and momentum on the regulatory side, digital receipts are not yet the standard, with only 34% of merchants offering them. The common question "Do you need a receipt?" will remain, as consumers are prompted to scan a QR code or enter an email address, yet many may still opt not to take the receipt, digital or not.

Today's e-receipts are designed more for the seller, focusing on lead generation and marketing, rather than consumer needs, which might explain the lack of receipt standardization. The promised features for consumers, such as standardized receipt formats, cross-application functionality, expense management, and better budgeting, along with expense management, are still missing, highlighting a gap in fulfilling consumer expectations and needs.

## The missing link: Automated delivery

While retailer apps are taking steps towards a more automated future – with consumers making a conscious decision once to enable the digital receipt in the app and then receiving their receipts automatically –, the true potential of automation, particularly at the checkout, has yet to be fully realized.

The simplest, yet most effective way to achieve this is through a direct connection to the payment process. The [French anti-waste law](https://www.legifrance.gouv.fr/loda/id/JORFTEXT000041553759) (Law No. 2020-105 of 10 February 2020 or “Loi anti-gaspillage”), aimed at controlling waste and promoting a circular economy, has been in effect since August 1st, 2023. This [regulation aims to increase consumer awareness](https://www.ecologie.gouv.fr/loi-anti-gaspillage-economie-circulaire) while reducing waste in various areas. Its objectives also include the elimination of harmful substances from receipts and the reduction of the substantial [paper waste generated by approximately 30 billion receipts annually](https://www.service-public.fr/particuliers/actualites/A16120?lang=en). Merchants now only have to provide printed receipts when asked explicitly by the customer.

The law's enforcement date was originally set for January 1st, 2023, but postponed in order to give POS vendors more time to incorporate digital receipt functionalities into their software.

This year’s Earth Day on April 22 is all about the motto “Invest in our planet”. Did you know that single-use paper receipts have a bigger impact on our health and the environment than you might realize?

## Paper receipts contain BPA

The chemical Bisphenol-A (BPA) commonly found in the thermal paper that is used for the printing of paper receipts, has been linked to various health issues, including cancer. Since BPA is readily absorbed through the skin, especially cashiers and people who handle receipts frequently are exposed to higher levels of the harmful substance than the general population.

## Paper receipts are non-recyclable

As most receipts are printed on thermal paper, which has a chemical lining, they cannot be recycled as paper. Paper receipts for single use are usually printed automatically, which leads to them being thrown away as direct waste. Digitizing receipts is the most sustainable option for providing and archiving receipts.

## Paper receipts use a lot of resources

The production of paper receipts requires significant amounts of natural resources. Besides the environmental impact of thermal paper, using non-thermal alternatives generally means higher printing costs for businesses. In thermal paper, the heat-sensitive coating material reacts to the heat generated by the thermal printer to produce the text or image. Because no ink or toner is required, the cost is lower compared to non-thermal printing methods. By contrast, digital receipts do not require physical materials, reducing waste, and saving businesses time and money.

Take your POS to the next level

Imagine this: you walk into a bakery to buy a donut or a croissant. Your treat is adorned with a sugar glaze receipt showing the price, quantity, and receipt number. In January 2020, 200 sugar glaze receipts embellished the traditional Bavarian filled donut (the so-called Krapfen), in a Bavarian bakery. This wasn't an expression of affection for the aesthetics of receipts by the bakers; it was a protest against the introduction of the [mandatory receipt issuance law in Germany](https://kassensichv.net/en/articles/receipt-issuance-obligation-in-germany-background-effects-and-alternatives) in January 2020.

The receipt issuance obligation aims to [ensure the transaction is recorded in the cash register system](https://www.spiegel.de/wirtschaft/service/bon-pflicht-neues-kassengesetz-hat-folgen-fuer-die-umwelt-a-1297036.html) and prevent tax evasion. "Stop the receipt and trash madness immediately," demanded the Central Association of the German Bakers back then. In response to protests from bakers and many other industries, the federal government sought to appease concerns by emphasizing that [receipts could also be issued electronically](https://www.spiegel.de/wirtschaft/service/scholz-erlaubt-wildwuchs-bei-digitalen-quittungen-a-08e30e90-f1b0-44f4-815d-b37c6e00b2bc). Concrete guidelines were however not forthcoming; implementation was left to individual companies.

## The e-receipt is here to stay
Today, transitioning to electronic receipts is only a matter of time. Bitkom states that [digital receipts already play a role for 44% of companies.](https://www.bitkom.org/Bitkom/Publikationen/Elektronische-Beleg-und-Rechnungsdaten-im-Jahr-2022) According to a [2022 study on POS systems by EHI](https://www.ehi.org/produkt/studie-pos-systeme-2022-pdf-version/), approximately 34% of all receipts in Germany can now be issued digitally.
