FAQs Crea y Crece Law and B2B eInvoicing

Passed in Spain in 2022, the Crea y Crece Law aims to boost business creation and fight late payments. One of its key measures is making B2B electronic invoicing mandatory.

An eInvoice is not just a PDF. It’s a structured, digitally signed document with standardized data that ensures integrity, authenticity, and traceability. It must include issuer and recipient details, invoice content (product lines, amounts, taxes, payment terms), and metadata for compliance checks.

It also requires a digital signature to prove authenticity and must be exchangeable via public or private platforms. Invoices must be trackable (accepted, rejected, paid) and stored securely for the legally required period.

In short, under Crea y Crece, an eInvoice is a structured, signed, regulated document that replaces traditional formats with full legal and technical guarantees.

It applies to businesses and professionals engaged in B2B transactions, when the recipient is also a company or professional. It currently does not apply to B2C transactions with final consumers.

Large companies (>€8 million turnover) will be required to comply first, followed by smaller businesses and freelancers once the technical regulation is finalized.

The timeline depends on the government’s approval of the Technical Regulation. Companies with turnover above €8 million will be the first to adapt, followed by all others.

You’ll need to issue invoices in structured formats (UBL or Facturae) with digital signatures and record statuses (sent, received, paid). Your ERP, POS, or billing software must:

  • Generate data according to the required schema
  • Use valid digital certificates for signing
  • Store and retain records as required by law
  • Integrate with public or private exchange platforms

The main formats are Facturae (XML-based, Spain) and UBL (European standard). fiskaly SIGN ES supports both and automatically adapts to future updates.
